What can I really expect from EMLA, Inc.?
Immediate, individualized attention is the hallmark of our service.
We meticulously analyze all facets of your case and conduct an in-depth
exploration for adversarial merit. Within 14 days, you will receive
a preliminary opinion stating whether or not the case appears meritorious.
This cost-effective initial review serves as the starting point
upon which the foundation of the case is laid. Beyond that, our
variety of options allows you to select any level of service including
complete, start-to-finish litigation support. For example, some
clients have us prepare a detailed case summary and analysis with
individual sections outlining duty, breach, harm, and causation.
The report provides an in-depth explanation of all medical terms
and processes, formulates a case strategy, and focuses on the requisite
elements of negligence. Depending on the complexity of the case,
reports vary between 5 and 30 pages. This explicit analysis gives
you the cost-effective information you need to make educated decisions
from the outset. Regardless of the level of service that you request,
a physician from EMLA, Inc., is there to personally assist you all
of the way.
How does the process work?
Once you contact EMLA, Inc., you will receive a complimentary telephone
consultation with a physician on our Board. Should you elect to
retain our services, we request a copy of the patient’s complete
medical record and all other related documents. Within 14 days,
we will telephone you to present our preliminary analysis and to
summarize EMLA’s opinion of your case.
If we deem the case to be preliminarily meritorious
and you elect to proceed, EMLA, Inc. can perform a detailed case
analysis. Both the initial and detailed analyses are performed by
a non-testifying expert and are intended to be protected as part
of your work product; they may not be submitted to opposing counsel
or be reviewed by any witness or party. Although you may elect to
have the same physician perform the preliminary review and act as
the testifying expert, the unique “dual review” protects
the case analysis from discovery, allows you to have a non-discoverable
strategic expert throughout the case, and provides a built-in “second
opinion” to assure the merit of the theory.
Should you choose to have a separate, testifying
expert, EMLA, Inc. will pre-screen and select a physician to independently
review the medical record and act in this capacity. Once “signed
onto the case," each expert is committed to serving you in
the highest professional capacity.
What does it cost to have EMLA, Inc. review
my case?
The initial telephone consultation is complimentary. Once we receive
the case materials, the preliminary case review with telephone discussion
is $1500. If the case is deemed non-meritorious, no further action
will be pursued. For meritorious claims, EMLA, Inc. will outline
a strategy and work to secure all requisite experts. Some attorneys
also request EMLA, Inc to perform an extensive case review and analysis.
This protected report outlines all of the pertinent elements of
negligence and then provides a full strategic analysis. Medical
terms and processes are simplified while relevant journal and textbook
citations are fully cited. Most reports take 8 to 15 hours to complete
with all time billed at an hourly rate. Of course, the initial $1500
fee is credited against this amount. Expert witness services are
also billed hourly after a one-time search and appointment fee.

What types of cases does EMLA, Inc. review?
EMLA, Inc. assists with all aspects of emergency medicine litigation
and lends its expertise to both plaintiff and defendant causes.
Typical cases of emergency medical negligence may result from care
provided in emergency departments, urgent care centers, or pre-hospital
settings, including ambulance or helicopter transports. Some primary
care physicians may also act negligently when evaluating seriously
ill patients or when providing limited “emergency services”
in their office. Forensic issues regarding mechanisms of injury,
alcohol intoxication, and toxicology are also part of emergency
medicine. All of these situations fall within EMLA’s scope
of practice.
What if I need an expert from a field
outside of emergency medicine?
EMLA, Inc. maintains a select group of rigorously screened specialists
from various medical fields. If a case requires additional experts,
EMLA, Inc. will assist in their procurement and assure that the
same high standards are upheld.
What are the qualifications of your experts?
All of our experts, both testifying and non-testifying, are true
experts. They are full-time, board-certified, practicing emergency
physicians. Absolutely none are “professional witnesses.”
Many of our experts hold appointments as academic faculty and have
sub-specialized within emergency medicine. Each hand-selected physician
independently reviews the medical record. If they are in agreement
and willing to testify, they “sign onto the case” and
will give you their full commitment until litigation is complete.
What if I am not satisfied with EMLA’s
service?
EMLA, Inc. is proud of its work. We unconditionally guarantee your
satisfaction. If you feel that any service is unsatisfactory in
any way, please let us know. We will ensure a professional product
or we will refund your fee.
